ข้อตกลงและเงื่อนไขการใช้งาน

โปรดอ่านข้อตกลงและเงื่อนไขการใช้งาน (“ข้อตกลง”) นี้ด้วยความระมัดระวังก่อนเข้าถึง และใช้งานเว็บไซต์ โดยการยอมรับข้อตกลงนี้ไม่ว่าจะด้วยวิธีการใดก็ตาม หรือเข้าถึง และ/หรือใช้งานเว็บไซต์นี้ ท่านได้ตกลงว่าท่านได้อ่าน และเข้าใจข้อตกลง และเงื่อนไขของข้อตกลงนี้โดยตลอดแล้ว และจึงได้ตกลงที่จะปฏิบัติตาม และเข้าผูกพันในข้อตกลงนี้ หากท่านไม่ตกลงกับข้อตกลง หรือเงื่อนไขใด ๆ ในข้อตกลงนี้ โปรดอย่าเข้าถึง หรือใช้งานเว็บไซต์นี้

ข้อตกลงนี้ระบุถึงเงื่อนไข และข้อปฏิบัติที่มีผลผูกพันระหว่างท่านซึ่งเป็นผู้ใช้งาน Uselessland ตามที่ได้นิยามไว้ด้านล่างนี้ (“ท่าน” “ของท่าน” หรือ “ผู้ใช้งาน”) และบริษัท 8-โฟล์ก จำกัด (“บริษัทฯ” “เรา” หรือ “ของเรา”) นิติบุคคลซึ่งได้จัดตั้งขึ้น และดำรงอยู่โดยชอบภายใต้กฎหมายแห่งประเทศไทย สำหรับการเข้าถึง และการใช้งาน Uselessland ของท่าน

1. คำนิยาม และการตีความ
1.1 เพื่อวัตถุประสงค์ของข้อกำหนดนี้ ให้คำดังนี้มีความหมายดังต่อไปนี้ เว้นแต่บริบทจะกำหนดไว้เป็นอื่น

คำนิยาม	ความหมาย
เนื้อหา	หมายถึง ข้อมูล ข้อความ รูปภาพ ภาพถ่าย หรือสิ่งอื่นใดก็ตามที่ปรากฏบนเว็บไซต์
เนื้อหาของผู้ใช้งาน	หมายถึง เนื้อหาที่สมาชิกได้ทำการส่ง ส่งผ่าน โพสต์ และ/หรืออัปโหลดบน Uselessland
บัญชีสมาชิก	หมายถึง บัญชีสมาชิกบน Uselessland
ผู้ใช้งาน	หมายถึง สมาชิก และผู้ใช้งานที่ไม่มีบัญชีสมาชิก
ผู้ใช้งานที่ไม่มีบัญชีสมาชิก	หมายถึง ผู้เยี่ยมชม และ/หรือผู้ใช้งาน Uselessland ซึ่งไม่ได้ทำการสมัครบัญชีสมาชิก หรือซึ่งเคยมีบัญชีสมาชิก แต่ได้ทำการยกเลิกบัญชีสมาชิกแล้ว หรือซึ่งบริษัทฯ ได้ทำการปิดบัญชีสมาชิกแล้ว
ผู้สร้างสรรค์	หมายถึง สมาชิกซึ่งเป็นผู้สร้างสรรค์สิ่งประดิษฐ์ และ/หรือเป็นผู้ทำการโพสต์ หรืออัปโหลดเนื้อหาของผู้ใช้งานบนเว็บไซต์
ผู้สร้างสรรค์ร่วม	หมายถึง บุคคลซึ่งได้ทำการสร้างสรรค์สิ่งประดิษฐ์ร่วมกันกับผู้ใช้งาน ทั้งนี้ ไม่ว่าบุคคลดังกล่าวจะเป็นผู้ใช้งานหรือไม่ก็ตาม
เว็บไซต์ หรือ Uselessland	หมายถึง เว็บไซต์ www.uselessland.com ซึ่งถือครอง และดำเนินการโดยบริษัทฯ
สิ่งประดิษฐ์	หมายถึง สิ่งใด ๆ ก็ตามที่ผู้สร้างสรรค์ได้ทำการค้นคว้า คิดค้น และสร้างสรรค์
สมาชิก	หมายถึง ผู้ใช้งานที่ได้สมัคร และมีบัญชีสมาชิกบน Uselessland
ผู้ปกครอง	หมายถึง บิดา มารดา ผู้มีอำนาจปกครอง หรือผู้แทนโดยชอบธรรมของผู้เยาว์ หรือผู้ที่มีความเปราะบาง แล้วแต่กรณี
ผู้เยาว์	หมายถึง บุคคลธรรมดาซี่งเป็นผู้ที่ยังไม่บรรลุนิติภาวะตามที่กฎหมายกำหนด กล่าวคือ มีอายุต่ำกว่า 20 (ยี่สิบ) ปีบริบูรณ์
ผู้ที่มีความเปราะบาง	หมายถึง บุคคลซึ่งเป็นผู้ไร้ความสามารถ หรือเสมือนไร้ความสามารถตามที่กฎหมายที่ใช้บังคับกำหนด

1.2 ข้อตกลงนี้จัดทำขึ้นเป็นภาษาไทย และภาษาอังกฤษ ในกรณีที่มีข้อขัดแย้งระหว่างกัน ให้ยึดถือข้อตกลงฉบับภาษาไทยเป็นหลัก

2. การเปลี่ยนแปลงแก้ไขข้อกำหนดนี้
บริษัทฯ สงวนสิทธิที่จะทำการเปลี่ยนแปลง แก้ไข หรือปรับเปลี่ยน (“เปลี่ยนแปลงแก้ไข”) ข้อตกลงนี้ในเวลาใดก็ได้ ไม่ว่าจะมีการบอกกล่าวหรือไม่ก็ตาม และให้การเปลี่ยนแปลงแก้ไขนี้มีผลใช้บังคับ ณ เวลาที่เราได้ระบุไว้ ทั้งนี้ เป็นหน้าที่ของท่านที่จะต้องตรวจสอบข้อตกลงฉบับนี้อย่างสม่ำเสมอเพื่อให้แน่ใจว่าท่านจะได้ทราบถึงการเปลี่ยนแปลงแก้ไขใด ๆ ที่อาจส่งผลกระทบต่อท่าน โดยการที่ท่านยังคงเข้าถึง หรือใช้งาน Uselessland ต่อภายหลังจากที่ได้มีการเปลี่ยนแปลงแก้ไขข้อตกลงนี้ ให้ถือว่าท่านได้ตกลงที่จะเข้าผูกพันในข้อตกลงนี้ซึ่งได้มีการแก้ไขเป็นครั้งคราว

แม้กระนั้นก็ตาม ในกรณีที่เราพิจารณาเห็นว่าการเปลี่ยนแปลงแก้ไขใด ๆ อาจมีผลกระทบต่อท่านอย่างมีนัยสำคัญ เราอาจบอกกล่าวให้ท่านทราบเป็นระยะเวลาตามสมควรก่อนที่การเปลี่ยนแปลงแก้ไขนั้นจะมีผลบังคับใช้

ทั้งนี้หากท่านไม่เห็นด้วยหรือประสงค์ที่จะปฏิเสธความมีผลผูกพันตามข้อตกลงฉบับนี้ ขอความกรุณาท่านยุติการเข้าชมและใช้งานเว็บไซต์นี้

3. บริการของ Uselessland
Uselessland มีวัตถุประสงค์เพื่อให้บริการแก่สมาชิกในการสร้างสรรค์ เก็บรักษา และแสดงผลงานสิ่งประดิษฐ์ของตน รวมถึงเพื่อให้สมาชิกได้รับคำแนะนำ หรือคำชี้แนะเกี่ยวกับสิ่งประดิษฐ์ของตนจากสมาชิกรายอื่น ๆ ที่มีบัญชีผู้ใช้งานและ/หรือจากบริษัทฯ เพื่อนำไปปรับปรุงแก้ไข หรือพัฒนาต่อยอดสิ่งประดิษฐ์ของสมาชิก และเพื่อให้สมาชิกเกิดความคิดสร้างสรรค์ในการประดิษฐ์สิ่งประดิษฐ์ใหม่ ๆ

4. การใช้งาน Uselessland โดยผู้เยาว์
4.1 การเข้าถึง และใช้งาน Uselessland โดยผู้เยาว์ เป็นไปตามข้อกำหนด และเงื่อนไขดังนี้

อายุ	ข้อกำหนดและเงื่อนไข
16 ปีขึ้นไป	สามารถสมัครบัญชีสมาชิกโดยใช้อีเมลของตัวเองได้ และโดยมิต้องได้รับความยินยอมจากผู้ปกครอง
13 – 15 ปี	สามารถสมัครบัญชีสมาชิกโดยใช้อีเมลของตัวเองได้ โดยต้องได้รับความยินยอมจากผู้ปกครอง
ต่ำกว่า 13 ปี	ห้ามสมัครบัญชีสมาชิก

4.2 ในกรณีที่บริษัทฯ ตรวจพบว่าท่านเป็นผู้เยาว์ที่มีอายุต่ำกว่า 13 (สิบสาม) ปี บริษัทฯ สงวนสิทธิในการระงับ หรือยกเลิกบัญชีสมาชิกของท่านโดยทันที โดยมิต้องบอกกล่าวล่วงหน้า และบริษัทฯ ไม่ต้องรับผิดใด ๆ ในการดำเนินการดังกล่าว

5. การสมัครบัญชีสมาชิก
5.1 ท่านไม่จำเป็นต้องทำการสมัครบัญชีสมาชิกเพื่อเข้าถึง Uselessland อย่างไรก็ตาม ผู้ใช้งานที่ไม่มีบัญชีสมาชิกจะไม่สามารถทำการโพสต์เนื้อหาใด ๆ บน Uselessland ได้ และการเข้าถึงเนื้อหาบน Uselessland ของท่านอาจถูกจำกัด

5.2 โดยการสมัครบัญชีสมาชิก ท่านยืนยันว่าท่านมีอายุไม่น้อยกว่า 16 (สิบหก) ปีบริบูรณ์ หรือในกรณีที่ท่านอายุระหว่าง 13 (สิบสาม) ถึง 15 (สิบห้า) ปี ท่านรับรองว่าท่านได้รับความยินยอมโดยชอบจากผู้ปกครองให้ทำการสมัครบัญชีสมาชิกแล้ว

การสมัครบัญชีสมาชิกโดยผู้ที่มีความเปราะบางจะต้องได้รับความยินยอมโดยชอบจากผู้ปกครอง และอยู่ภายใต้การควบคุมดูแลของผู้ปกครองเท่านั้น

บริษัทฯ สงวนสิทธิในการขอเอกสารหลักฐานการให้ความยินยอมดังกล่าวได้ทุกเมื่อตามที่บริษัทฯ เห็นสมควร หากท่านมิได้ส่งมอบเอกสารหลักฐานให้แก่บริษัทฯ ภายในระยะเวลาตามสมควร บริษัทฯ สงวนสิทธิในการระงับ หรือยกเลิกบัญชีสมาชิกของท่านโดยทันที โดยมิต้องบอกกล่าวล่วงหน้า และบริษัทฯ ไม่ต้องรับผิดใด ๆ ในการดำเนินการดังกล่าว

5.3 ในการสมัครบัญชีสมาชิก ท่านยอมรับว่าท่านได้ให้ข้อมูลที่ถูกต้อง ครบถ้วน เป็นปัจจุบัน และไม่เป็นข้อมูลที่บิดเบือน หรือเป็นเท็จ ทั้งนี้ หากมีการเปลี่ยนแปลงข้อมูลใด ๆ ที่ท่านได้ให้ไว้ ท่านจะต้องดำเนินการแก้ไขข้อมูลดังกล่าวบน Uselessland โดยตั้งค่าที่ www.uselessland.com/account หากสามารถกระทำได้ หรือแจ้งให้บริษัทฯ ทราบถึงการเปลี่ยนแปลงดังกล่าวโดยมิชักช้าตามรายละเอียดข้อมูลติดต่อของบริษัทฯ ด้านล่างนี้ ทั้งนี้ บริษัทฯ สงวนสิทธิในการขอเรียกดูเอกสารหลักฐานเพื่อตรวจสอบความถูกต้องของการเปลี่ยนแปลงนั้นตามที่บริษัทฯ เห็นสมควร

5.4 ในการสมัครบัญชีสมาชิก ท่านจะต้องไม่ใช้ข้อมูลของบุคคลอื่นโดยมิได้รับความยินยอม และจะต้องไม่ปลอมแปลงเป็นบุคคลอื่น ผู้ใดแอบอ้าง หรือกระทำการใด ๆ อันเป็นการละเมิดสิทธิส่วนบุคคล โดยใช้ข้อมูลของผู้อื่นมาแอบอ้าง ถือเป็นความผิด ต้องรับโทษตามที่กฎหมายกำหนดไว้

5.5 เมื่อท่านได้ทำการสมัครบัญชีสมาชิกบน Uselessland ท่านจะได้รับอีเมลจากบริษัทฯ เพื่อใช้ในการพิสูจน์ยืนยันตัวตนของท่าน หากท่านไม่ได้ทำการพิสูจน์ยืนยันภายในระยะเวลาที่กำหนด การสมัครบัญชีสมาชิกของท่านจะถูกยกเลิกโดยอัตโนมัติ อย่างไรก็ตาม โปรดทราบว่าบริษัทฯ สงวนสิทธิแต่เพียงผู้เดียวในการพิจารณาอนุมัติ หรือปฏิเสธคำขอสมัครบัญชีสมาชิกของท่าน

5.6 ท่านรับทราบ และเข้าใจว่าข้อมูลเกี่ยวกับบัญชีสมาชิก และรหัสผ่านถือเป็นข้อมูลอันเป็นความลับ และท่านจะต้องไม่เปิดเผยให้ผู้ใดทราบถึงข้อมูลดังกล่าว และจะต้องไม่อนุญาตให้ผู้ใดเข้าใช้งานบัญชีสมาชิกของท่าน การดำเนินการใด ๆ ภายใต้บัญชีสมาชิกของท่านถือเป็นการดำเนินการโดยท่านทั้งสิ้น ทั้งนี้ หากท่านทราบ หรือมีเหตุอันควรสงสัยว่าได้มีการเข้าถึง หรือใช้งานบัญชีสมาชิกของท่านโดยมิชอบ หรือโดยปราศจากอำนาจ ท่านจะต้องแจ้งให้บริษัทฯ ทราบถึงการเข้าถึง หรือการใช้งานดังกล่าวโดยทันที

5.7 เนื่องจาก บริษัทฯ ตั้งใจให้ Uselessland เป็นพื้นที่ในการสร้างสรรค์ และพัฒนาสิ่งประดิษฐ์สำหรับบุคคลทั่วไป โดยเฉพาะอย่างยิ่งบุคคลซึ่งเป็นผู้เยาว์ บริษัทฯ จึงให้ความสำคัญกับการดำเนินการให้ Uselessland มีสภาพแวดล้อมที่เหมาะสมกับผู้เยาว์ ด้วยเหตุนี้ บริษัทฯ จึงไม่อนุญาตให้สมาชิกทำการอัปโหลดภาพใด ๆ เพื่อใช้เป็นรูปโปรไฟล์ (Profile) ของบัญชีสมาชิกเพื่อรักษาความเป็นส่วนตัวของท่าน อย่างไรก็ตาม ท่านสามารถเปลี่ยนสีรูปโปรไฟล์ของท่านได้ตามที่ท่านต้องการ หากท่านไม่ได้ทำการเลือกสีที่จะใช้ในการแสดงรูปโปรไฟล์ของท่าน ระบบจะทำการสุ่มเลือกสีให้ท่านโดยอัตโนมัติ โดยท่านสามารถทำการเปลี่ยนแปลงสีดังกล่าวได้ในภายหลัง

5.8 บริษัทฯ ไม่ได้เรียกเก็บค่าบริการจากการสมัครบัญชีสมาชิก Uselessland อย่างไรก็ตาม การใช้งาน Uselessland อาจก่อให้เกิดค่าใช้จ่ายจากการใช้เครือข่ายโทรคมนาคม และ/หรือเครือข่ายอินเทอร์เน็ตของท่าน ซึ่งท่านจะต้องเป็นผู้รับผิดชอบในค่าใช้จ่ายดังกล่าวด้วยตัวท่านเองแต่เพียงผู้เดียว ในส่วนของอัตราค่าใช้จ่ายดังกล่าว โปรดตรวจสอบกับผู้ให้บริการเครือข่ายโทรคมนาคม และ/หรือเครือข่ายอินเทอร์เน็ตของท่าน

6. การโพสต์เนื้อหาของผู้ใช้งานเกี่ยวกับสิ่งประดิษฐ์ และสิทธิในการใช้บริการ Uselessland
6.1 เฉพาะสมาชิกเท่านั้นจึงจะสามารถโพสต์ภาพ และรายละเอียดสิ่งประดิษฐ์ของตนบน Uselessland ได้ ทั้งนี้ ในการโพสต์ภาพ และรายละเอียดสิ่งประดิษฐ์ใด ๆ ท่านรับรอง และยืนยันว่าสิ่งประดิษฐ์นั้นเป็นผลงานของท่านเอง หรือในกรณีของผู้ปกครอง ท่านรับรอง และยืนยันว่าสิ่งประดิษฐ์นั้นเป็นผลงานของผู้เยาว์ หรือผู้มีความเปราะบางในความปกครองของท่านเอง

6.2 ท่านสามารถโพสต์รูปภาพเกี่ยวกับสิ่งประดิษฐ์ของท่านได้ ทั้งนี้ เพื่อความปลอดภัย และความเป็นส่วนตัวของท่าน บริษัทฯ ขอให้ท่านหลีกเลี่ยงการโพสต์ภาพบุคคลใด ๆ รวมถึงตัวท่านเอง

6.3 ในการโพสต์ภาพ และรายละเอียดสิ่งประดิษฐ์ (“เนื้อหาเกี่ยวกับสิ่งประดิษฐ์”) ท่านสามารถตั้งค่าการมองเห็นสิ่งประดิษฐ์ของท่านได้ตามความต้องการ และสามารถปรับเปลี่ยนการตั้งค่าได้ทุกเมื่อ ทั้งนี้ รายละเอียดของการตั้งค่าในรูปแบบต่าง ๆ มีดังนี้

สาธารณะ (On U Things)	ในกรณีที่ผู้สร้างสรรค์ตั้งค่าเนื้อหาเกี่ยวกับสิ่งประดิษฐ์ไว้เป็น “สาธารณะ (On U Things)” ผู้ใช้งานที่มีบัญชีสมาชิก และผู้ใช้งานที่ไม่มีบัญชีสมาชิกจะสามารถเห็นสิ่งประดิษฐ์ของท่านได้ อย่างไรก็ตาม ผู้ใช้งานที่ไม่มีบัญชีสมาชิกจะไม่สามารถโพสต์ความเห็นใน Chitchat ไม่สามารถกดให้ Clap และไม่สามารถ Clip สิ่งประดิษฐ์ชิ้นนั้นได้ หากท่านไม่ประสงค์จะให้ผู้ใช้งานที่ไม่มีบัญชีสมาชิกเห็นสิ่งประดิษฐ์ หรือเนื้อหาใด ๆ ท่านสามารถตั้งค่าเนื้อหาเกี่ยวกับสิ่งประดิษฐ์ให้เป็น “ส่วนตัว (Private)” ได้ ในกรณีที่ท่านได้ตั้งค่าไว้เป็นสาธารณะ บริษัทฯ อาจนำภาพสิ่งประดิษฐ์ของท่านไปใช้ เพื่อวัตถุประสงค์ด้านการโฆษณา และการตลาดของบริษัทฯ ผ่านสื่อต่าง ๆ ทั้งนี้ บริษัทฯ จะทำการขออนุญาตจากท่านก่อนการดำเนินการดังกล่าว
ต้องการความช่วยเหลือ (Need-Help)	กรณีที่ผู้สร้างสรรค์ประสงค์ที่ปรึกษาหารือ เปิดรับความคิดเห็น และคำแนะนำจากสมาชิกรายอื่น ๆ เพื่อปรับปรุงแก้ไข พัฒนา และ/หรือดำเนินการใด ๆ เกี่ยวกับสิ่งประดิษฐ์ของตน ให้ตั้งค่าเนื้อหาเกี่ยวกับสิ่งประดิษฐ์เป็น “ต้องการความช่วยเหลือ” เมื่อท่านได้ตั้งค่าไว้ให้เป็น “ต้องการความช่วยเหลือ” เนื้อหาเกี่ยวกับสิ่งประดิษฐ์ของท่านจะ ปรากฏบนหน้ากระดานให้ความช่วยเหลือ (Help Board) ซึ่งสมาชิกรายอื่นจะสามารถโพสต์แสดงความคิดเห็น ให้คำแนะนำ และข้อเสนอแนะแก่ท่านได้
เป็นส่วนตัว (Private)	กรณีที่ผู้สร้างสรรค์ไม่ต้องการให้ผู้ใช้งานรายอื่นใดเห็นเนื้อหาเกี่ยวกับสิ่งประดิษฐ์ ให้ตั้งค่าเนื้อหานั้นว่า “เป็นส่วนตัว”
โต๊ะทำงาน (Workbench)	สำหรับเนื้อหาเกี่ยวกับสิ่งประดิษฐ์ที่ยังไม่เสร็จสมบูรณ์ หรือเป็นฉบับร่าง หากท่านตั้งค่าสถานะสิ่งประดิษฐ์ว่า “โต๊ะทำงาน” ผู้ใช้งานรายอื่นจะไม่สามารถเห็นรูปภาพ และรายละเอียดเกี่ยวกับสิ่งประดิษฐ์ของท่าน

6.4 ท่านสามารถตั้งค่าการมองเห็นสิ่งประดิษฐ์ของท่านได้ตามความต้องการ โดยการตั้งค่าต่าง ๆ มีรายละเอียดดังนี้

การตั้งค่า	การมองเห็นโดยเจ้าของสิ่งประดิษฐ์	การมองเห็นโดยสมาชิกรายอื่น	การมองเห็นเฉพาะภาพแรกของสิ่งประดิษฐ์โดยผู้ใช้งานรายอื่นที่ไม่มีบัญชีสมาชิก
สาธารณะ (On U Things)			*

เป็นส่วนตัว (Private)
โต๊ะทำงาน (Workbench)

*หมายเหตุ ผู้ใช้งานที่ไม่มีบัญชีสมาชิกจะเห็นสิ่งประดิษฐ์ได้ แต่จะไม่สามารถโพสต์ความเห็นใน Chitchat ไม่สามารถกดให้ Clap และไม่สามารถ Clip สิ่งประดิษฐ์ชิ้นนั้นได้

6.5 ในการโพสต์เนื้อหาเกี่ยวกับสิ่งประดิษฐ์ ผู้สร้างสรรค์สามารถระบุถึงผู้สร้างสรรค์ร่วมที่มีบัญชีสมาชิกได้ และสามารถระบุถึงผู้สร้างสรรค์ร่วมที่ไม่มีบัญชีสมาชิกได้เช่นกัน ทั้งนี้ บริษัทฯ ขอให้ท่านงดเว้นการระบุชื่อจริงของผู้สร้างสรรค์ร่วมไม่ว่าในกรณีใดก็ตาม

6.6 ในกรณีที่ท่านได้เปลี่ยนแปลงการตั้งค่าเนื้อหาเกี่ยวกับสิ่งประดิษฐ์ของท่านจาก “ต้องการความช่วยเหลือ” เป็น “สาธารณะ” เนื้อหาเกี่ยวกับสิ่งประดิษฐ์ของท่านจะถูกนำออกจากกระดานให้ความช่วยเหลือ และสมาชิกรายอื่น ๆ จะไม่สามารถแสดงความคิดเห็น ให้คำแนะนำ หรือข้อเสนอแนะได้อีก อย่างไรก็ตาม ความคิดเห็น คำแนะนำ และข้อเสนอแนะที่สมาชิกรายอื่นได้ให้ไว้แก่ท่านก่อนที่ท่านจะทำการเปลี่ยนแปลงการตั้งค่าอาจถูกแสดงไว้เป็นสาธารณะ

7. การโพสต์เนื้อหาของผู้ใช้งาน
7.1 เนื้อหาของผู้ใช้งานใด ๆ ที่ท่านได้ส่ง ส่งผ่าน โพสต์ หรืออัปโหลดบน Uselessland ถือเป็นเนื้อหาของผู้ใช้งาน

7.2 โดยขึ้นอยู่กับการตั้งค่าการมองเห็นสำหรับเนื้อหาเกี่ยวกับสิ่งประดิษฐ์ของผู้สร้างสรรค์ สมาชิกรายอื่นสามารถแสดงความคิดเห็นในเนื้อหาเกี่ยวกับสิ่งประดิษฐ์ของผู้สร้างสรรค์รายดังกล่าวได้ผ่านช่องทาง “Chitchat” และ “ต้องการความช่วยเหลือ”

7.3 ข้อความใด ๆ ที่ได้โพสต์ผ่านทางช่องทาง “Chitchat” และ “ต้องการความช่วยเหลือ” จะสามารถมองเห็น และเข้าถึงได้โดยสมาชิกรายอื่น ดังนั้น บริษัทฯ จึงแนะนำให้ท่านใช้ความระมัดระวัง ในการแสดงความคิดเห็น และโปรดหลีกเลี่ยงการโพสต์ข้อมูลส่วนบุคคล หรือข้อมูลใด ๆ ที่เป็นความลับ หรือมีความอ่อนไหว

7.4 ท่านสามารถลบความความคิดเห็นของท่านได้ทุกเมื่อ นอกจากนี้ผู้สร้างสรรค์สามารถลบความคิดเห็นของท่าน ในเนื้อหาเกี่ยวกับสิ่งประดิษฐ์ของผู้สร้างสรรค์ได้เช่นกัน (ฟังก์ชันนี้ยังไม่เปิดให้ใช้งาน)

7.5 ท่านสามารถบันทึกเนื้อหาเกี่ยวกับสิ่งประดิษฐ์ที่ท่านสนใจได้ โดยการกดที่ปุ่มคลิป (Clip) เนื้อหาเกี่ยวกับสิ่งประดิษฐ์นั้นจะปรากฏในกระดานบันทึก (Keeps) (ฟังก์ชันนี้ยังไม่เปิดให้ใช้งาน)

8. การนำเสนอวัสดุ หรือเครื่องมือ
ระบบของเว็บไซต์อาจนำเสนอวัสดุ หรือเครื่องมือที่เหมาะกับสิ่งประดิษฐ์ของท่านโดยอัตโนมัติ เพื่อให้ท่านอาจพิจารณานำไปใช้ในการพัฒนาสิ่งประดิษฐ์ของท่าน ทั้งนี้ การเสนอดังกล่าวจะขึ้นอยู่กับข้อมูล และรายละเอียดสิ่งประดิษฐ์ที่ท่านได้โพสต์ไว้

9. การให้คะแนนความคิดสร้างสรรค์ (ฟีเจอร์นี้ยังไม่เปิดให้ใช้งานในปัจจุบัน)
ในกรณีที่ท่านต้องการให้บริษัทฯ ทำการประมวลผลข้อมูล และรายละเอียดสิ่งประดิษฐ์ของท่าน เพื่อให้คะแนนความคิดสร้างสรรค์ (Creative Score) สำหรับสิ่งประดิษฐ์นั้น ๆ ท่านสามารถเลือก “Give me score!” หรือท่านอาจทำการให้คะแนนความคิดสร้างสรรค์แก่สิ่งประดิษฐ์ชองตนเองได้ ทั้งนี้ ผู้ใช้งานรายอื่นจะไม่สามารถเห็นคะแนนความคิดสร้างสรรค์นี้ได้

10. ข้อจำกัดในการใช้งาน Uselessland
10.1 ท่านจะต้องไม่ใช้งาน Uselessland เพื่อวัตถุประสงค์เชิงพาณิชย์ใด ๆ

10.2 ห้ามมิให้ท่านโพสต์ หรืออัปโหลดเนื้อหาของผู้ใช้งานใด ๆ บนเว็บไซต์ซึ่งมีลักษณะดังนี้

10.2.1 เนื้อหาของผู้ใช้งานใด ๆ ที่อาจก่อให้เกิดความเสียหายแก่บริษัทฯ ผู้ใช้งานรายอื่น หรือบุคคลภายนอกใด ๆ

10.2.2 เนื้อหาของผู้ใช้งานใด ๆ ซึ่งก่อให้เกิดความขัดแย้ง หรือสร้างความความแตกแยกแก่ผู้อื่น หรือก่อให้เกิดความรำคาญ หรือความเกลียดชังใด ๆ

10.2.3 เนื้อหาของผู้ใช้งานใด ๆ ซึ่งเป็นการละเมิดสิทธิใด ๆ ของบริษัทฯ ผู้ใช้งานรายอื่น หรือบุคคลภายนอก ซึ่งรวมถึงแต่ไม่จำกัดเพียงสิทธิในทรัพย์สินทางปัญญา

10.2.4 เนื้อหาของผู้ใช้งานใด ๆ ซึ่งเป็นเท็จ บิดเบือน ไม่เป็นความจริง หรืออาจก่อให้เกิดความใจผิด

10.2.5 เนื้อหาของผู้ใช้งานใด ๆ ที่เป็นการหมิ่นประมาท หรือทำลายชื่อเสียงของบุคคลอื่น

10.2.6 เนื้อหาของผู้ใช้งานใด ๆ เกี่ยวกับอาวุธ วัตถุระเบิด ความรุนแรง ภาพอนาจาร หรือสื่อลามกทุกประเภท

10.2.7 เนื้อหาของผู้ใช้งานใด ๆ ที่มิชอบด้วยกฎหมาย หรือเป็นการฝ่าฝืน หรือละเมิดกฎหมาย กฎระเบียบ หรือกฎเกณฑ์ใด ๆ ที่ใช้บังคับ

10.2.8 เนื้อหาของผู้ใช้งานใด ๆ ที่ขัดต่อความสงบสุขเรียบร้อย และศีลธรรมอันดีของประชาชน

10.2.9 เนื้อหาของผู้ใช้งานใด ๆ ที่สามารถใช้ในการระบุตัวตนของบุคคลใด ๆ ได้ รวมถึงการระบุตัวตนของท่านเอง เช่น ภาพใบหน้า บ้านเลขที่ และทะเบียนรถ เป็นต้น

10.3 ท่านจะต้องไม่ใช้งาน Uselessland ในลักษณะที่ก่อให้เกิดความเสียหายต่อเว็บไซต์ หรือในลักษณะที่เป็นการขัดขวาง หรือรบกวนการทำงานของเว็บไซต์ ซึ่งรวมถึงแต่ไม่จำกัดเพียง การไม่นำซึ่งมัลแวร์ ไวรัส เวิร์ม หรือสิ่งอื่นใดที่มีลักษณะคล้ายคลึงกันเข้าสู่ระบบ หรือเว็บไซต์

10.4 บริษัทฯ สงวนสิทธิแต่เพียงผู้เดียวในการตรวจสอบเนื้อหาของผู้ใช้งานได้ตามความเหมาะสม รวมถึงสงวนสิทธิที่จะใช้ดุลยพินิจแต่เพียงผู้เดียวในการพิจารณาที่จะลบ หรือนำออกซึ่งเนื้อหาใด ๆ ของผู้ใช้งานซึ่งไม่เป็นไปตามข้อตกลงนี้ โดยมิต้องบอกกล่าวล่วงหน้า และบริษัทฯ ไม่ต้องรับผิด หรือรับผิดชอบใด ๆ ในการดำเนินการดังกล่าว

10.5 ในกรณีที่บริษัทฯ ได้ทำการลบ หรือนำออกซึ่งเนื้อหาของผู้ใช้งานใด ๆ ของท่าน และท่านประสงค์ที่จะโต้แย้งการดำเนินการดังกล่าวของบริษัทฯ ท่านสามารถยื่นอุทธรณ์ พร้อมเอกสารหลักฐานต่าง ๆ (หากมี) ให้แก่บริษัทฯ ที่ hi@uselessland.com ภายในระยะเวลา 14 (สิบสี่) วันนับจากวันที่ได้มีการลบ หรือนำออกซึ่งเนื้อหาของผู้ใช้งานดังกล่าว ทั้งนี้ การพิจารณาใด ๆ เป็นไปตามดุลยพินิจของบริษัทฯ แต่เพียงผู้เดียว และคำตัดสินของบริษัทฯ นั้นให้ถือเป็นที่สุด

11. การระงับ หรือปิดบัญชีผู้ใช้งาน
11.1 บริษัทฯ สงวนสิทธิแต่เพียงผู้เดียวในการพิจารณาระงับ หรือปิดบัญชีสมาชิกของท่านโดยมิต้องบอกกล่าวล่วงหน้าหากท่านได้ฝ่าฝืน หรือไม่ปฏิบัติตามข้อหนึ่งข้อใดในข้อตกลงนี้ หรือกฎหมาย กฎเกณฑ์ หรือกฎระเบียบที่ใช้บังคับ หรือหากบริษัทฯ มีเหตุสมควรเชื่อได้ว่าจะกระทำการดังกล่าว ทั้งนี้ ภายใต้ขอบเขตสูงสุดที่กฎหมายอนุญาตให้กระทำได้ บริษัทฯ ไม่ต้องรับผิด หรือรับผิดชอบใด ๆ ในการระงับ หรือปิดบัญชีสมาชิกดังกล่าว

11.2 ในกรณีที่บริษัทฯ จะยุติการให้บริการ Uselessland ไม่ว่าทั้งหมด หรือแต่บางส่วน บริษัทฯ จะแจ้งให้ท่านทราบล่วงหน้าอย่างน้อย 30 (สามสิบ) วัน เพื่อให้ท่านมีเวลาพอสมควรในการบันทึกเนื้อหาของผู้ใช้งานของท่าน

11.3 หากท่านไม่ประสงค์ที่จะใช้งาน Uselessland ท่านสามารถทำการลบบัญชีสมาชิกของท่านได้ทุกเมื่อ โดยตั้งค่าที่ https://www.uselessland.com/account

12. ข้อมูลอันเป็นความลับ
บริษัทฯ ขอรับรองว่าจะเก็บรักษาข้อมูลใด ๆ ที่ผู้ใช้งานได้ให้ไว้แก่บริษัทฯ ไว้เป็นความลับ และจะไม่ทำการเปิดเผยข้อมูลใด ๆ ดังกล่าวให้แก่บุคคลภายนอกทราบโดยมิได้รับความยินยอมจากท่าน เว้นแต่ในกรณีที่ได้ระบุไว้ในข้อตกลงนี้ และ/หรือเป็นการเปิดเผยให้ผู้ให้บริการของบริษัทฯ ทราบเพื่อวัตถุประสงค์ของข้อตกลงนี้ ทั้งนี้ ข้อมูลอันเป็นความลับไม่รวมถึงข้อมูลที่ท่านได้เปิดเผยแก่สาธารณะ อย่างไรก็ตาม ท่านรับทราบว่า บริษัทฯ อาจจำเป็นต้องเปิดเผยข้อมูลใด ๆ ของท่านเพื่อปฏิบัติตามกฎหมายที่ใช้บังคับ คำสั่งศาล หรือคำสั่งของเจ้าหน้าที่ผู้มีอำนาจ สำหรับรายชื่อบุคคลภายนอกที่อาจได้รับการเปิดเผยข้อมูลส่วนบุคคล โปรดดูนโยบายคุ้มครองข้อมูลส่วนบุคคลของบริษัทฯ (https://www.uselessland.com/privacy)

13. สิทธิในทรัพย์สินทางปัญญา
13.1 เว้นแต่ที่ได้ระบุไว้ในข้อ 12.2 บริษัทฯ เป็นเจ้าของสิทธิ และผลประโยชน์ใด ๆ ทั้งปวงอันเกี่ยวกับเว็บไซต์นี้แต่เพียงผู้เดียว ซึ่งรวมถึงแต่ไม่จำกัดเพียงเนื้อหา การออกแบบ ข้อความ รูปวาด ภาพถ่าย เครื่องหมายการค้า โลโก้ และทรัพย์สินทางปัญญาอื่น ๆ ยกเว้นจะมีการระบุอย่างชัดเจนเป็นอื่น ห้ามมิให้ผู้ใดทำการคัดลอก ทำซ้ำ มีสำเนา สำรองไว้ ทำเลียนแบบ ทำเหมือน ดัดแปลง ทำเพิ่ม เพื่อนำไปเผยแพร่ด้วยวัตถุประสงค์อื่นใด โดยปราศจากความยินยอมเป็นหนังสือจากบริษัท ฯ

13.2 ผู้ใช้งานรับรองว่าเนื้อหาของผู้ใช้งานที่ได้ทำการโพสต์บนเว็บไซต์ไม่ได้เป็นการละเมิดสิทธิในทรัพย์สินทางปัญญาของผู้อื่นแต่อย่างใด ทั้งนี้ โดยการโพสต์เนื้อหาของผู้ใช้งานบนเว็บไซต์ ผู้ใช้งานอนุญาตให้บริษัทฯ ใช้สิทธิในเนื้อหาของผู้ใช้งานดังกล่าวได้ โดยเป็นสิทธิที่ไม่เด็ดขาด ไม่อาจเพิกถอนได้ ไม่มีค่าตอบแทน และสามารถใช้ได้ทั่วโลก ซึ่งรวมถึงสิทธิในการแก้ไข เปลี่ยนแปลง และเผยแพร่ในช่องทางต่าง ๆ ตามที่บริษัทฯ เห็นสมควร ทั้งนี้ ผู้ใช้งานอนุญาตให้บริษัทฯ ใช้สิทธิดังกล่าวได้ตลอดไปแม้ว่าผู้ใช้งานจะได้ทำการลบเนื้อหาของผู้ใช้งานออกจากเว็บไซต์แล้วก็ตาม

14. ข้อมูลส่วนบุคคล
ข้อมูลส่วนบุคคลของท่านที่ท่านได้ให้ไว้แก่บริษัทฯ หรือที่บริษัทฯ ได้เก็บรวบรวมจากการเข้าถึง และ/หรือใช้งาน Uselessland ของท่าน จะเป็นไปตามที่ได้กำหนดไว้ในนโยบายคุ้มครองข้อมูลส่วนบุคคลของบริษัทฯ (https://www.uselessland.com/privacy) ข้อกำหนดของนโยบายคุ้มครองข้อมูลส่วนบุคคลของบริษัทฯ นั้นให้ถือเป็นส่วนหนึ่งของข้อกำหนดฉบับนี้โดยการอ้างอิงถึง ด้วยเหตุนี้ โปรดอ่านนโยบายคุ้มครองข้อมูลส่วนบุคคลของเราอย่างละเอียดถี่ถ้วน และด้วยความระมัดระวัง

15. ข้อสงวนสิทธิ
15.1 บริษัทฯ ไม่รับประกัน หรือรับรองว่า Uselessland จะพร้อมใช้งานอยู่เสมอ ทั้งนี้ การให้บริการ Uselessland นั้นเป็นไปตามพื้นฐานของ “ตามที่เป็น” และ “ตามที่มี” เท่านั้น ท่านจะต้องใช้ดุลยพินิจของท่านแต่เพียงผู้เดียวในการพิจารณาว่าจะสามารถใช้งาน Uselessland ได้ตาม และ/หรือเหมาะสมกับวัตถุประสงค์อันเฉพาะเจาะจงของท่านหรือไม่

15.2 วัตถุประสงค์ของ Uselessland นั้นเป็นไปเพื่อการก่อให้เกิดการเรียนรู้ และพัฒนาสิ่งต่าง ๆ ซึ่งหมายถึงบริษัทฯ อาจทำการเปลี่ยนแปลง ปรับเปลี่ยน หรืออัปเดต Uselessland ได้ตลอดเวลาเพื่อให้ประสิทธิภาพการทำงานของ Uselessland นั้นดียิ่งขึ้น และเป็นไปตามวัตถุประสงค์ ด้วยเหตุนี้ บริษัทฯ จึงไม่รับรอง และไม่รับประกันว่า Uselessland นั้นจะยังคงเดิมเสมอไป

15.3 แม้ว่าบริษัทฯ จะทำการสำรองข้อมูลเป็นครั้งคราว แต่บริษัทฯ ไม่รับประกันว่าข้อมูลใด ๆ รวมถึงเนื้อหาของผู้ใช้งานนั้นจะไม่เสียหาย หรือสูญหาย

15.4 บริษัทฯ ไม่รับรองความถูกต้อง หรือความสมบูรณ์ของเนื้อหาใด ๆ ซึ่งปรากฏบน Uselessland และไม่ประกันว่าเนื้อหาเหล่านั้นจะปราศจากการละเมิดสิทธิของผู้ใช้งาน หรือบุคคลภายนอกอื่นใด อย่างไรก็ตาม หากบริษัทฯ พบ หรือได้รับแจ้งถึงความไม่ถูกต้อง ไม่สมบูรณ์ หรือการละเมิดสิทธิใด ๆ บริษัทฯ จะตรวจสอบ และดำเนินการใด ๆ ที่จำเป็นเพื่อลบ หรือนำเนื้อหาเหล่านั้นออกจากเว็บไซต์

15.5 บริษัทฯ ไม่รับประกันว่า Uselessland จะปราศจากซึ่งมัลแวร์ ไวรัส เวิร์ม หรือสิ่งอื่นใดที่มีลักษณะคล้ายคลึงกัน

15.6 บริษัทฯ ไม่รับประกัน หรือรับรองว่า Uselessland จะสามารถใช้งานได้กับอุปกรณ์ และ/หรือซอฟต์แวร์ใด ๆ ของท่าน

15.7 บริษัทฯ สงวนสิทธิ์ในการพิจารณาไม่อนุญาตให้ผู้ใช้งานใช้งาน Uselessland รวมถึงสงวนสิทธิในการเปลี่ยนแปลง หรือระงับการให้บริการเว็บไซต์ไม่ว่าบางส่วนหรือทั้งหมด และไม่ว่าในเวลาใด ๆ แก่ผู้ใช้งาน

16. ข้อจำกัดความรับผิด
16.1 ภายใต้ขอบเขตสูงสุดที่กฎหมายอนุญาตให้กระทำได้ บริษัทฯ จะไม่รับผิดชอบ หรือรับผิดต่อความเสียหาย ความสูญเสีย ความรับผิด หรือค่าใช้จ่ายใด ๆ ที่เกิดจาก หรือเกี่ยวเนื่องกับการใช้งาน Uselessland ของท่าน หรืออันเกิดจากความผิดพลาด การขาดหาย การรบกวน หรือความล่าช้าในการทำงานใด ๆ ของเว็บไซต์

16.2 ไม่มีข้อความใดในข้อกำหนดนี้ที่ถือเป็นการจำกัดความรับผิด (ก) อันเกิดจากความจงใจ หรือประมาทเลินเล่ออย่างร้ายแรงของบริษัทฯ (ข) เกี่ยวกับการเสียชีวิต หรือบาดเจ็บ (ค) ที่ต้องห้ามชัดแจ้งโดยกฎหมาย และ (ง) ซึ่งขัดต่อความสงบเรียบร้อย หรือศีลธรรมอันดีของประชาชน

17. การชดใช้ค่าเสียหาย
ท่านตกลงรับผิดชอบชดใช้ค่าเสียหาย และปกป้องบริษัทฯ รวมถึงกรรมการ เจ้าหน้าที่ ลูกจ้าง ตัวแทน และผู้แทนใด ๆ ของบริษัทฯ จากความเสียหาย ความสูญเสีย ความรับผิด และความรับผิดชอบใด ๆ ทั้งปวง (รวมถึงค่าวิชาชีพทนายความตามสมควร) ที่เกิดขึ้นจาก หรือเกี่ยวเนื่องกับการที่ท่านเข้าถึง และ/หรือใช้งาน Uselessland ในลักษณะที่เป็นการฝ่าฝืน หรือไม่ปฏิบัติตามข้อตกลงนี้ หรือกฎหมายที่ใช้บังคับ

18. การสละสิทธิ
การที่บริษัทฯ ล่าช้าในการใช้สิทธิ หรือไม่ได้ใช้สิทธิใด ๆ ภายใต้ข้อกำหนดนี้ หรือกฎหมายที่ใช้บังคับ ไม่ว่าทั้งหมด หรือแต่บางส่วน ความล่าช้า หรือการไม่ได้ใช้สิทธิใด ๆ นั้นย่อมไม่ถือเป็นการสละสิทธิดังกล่าวโดยบริษัทฯ

19. การบอกกล่าว
หากท่านประสงค์จะทำการบอกกล่าวใด ๆ แก่บริษัทฯ โปรดส่งคำบอกกล่าวดังกล่าวมาตามรายละเอียดข้อมูลการติดต่อของบริษัทฯ ตามที่ได้ระบุไว้ด้านล่างนี้ ทั้งนี้ ในกรณีที่บริษัทฯ จะทำการบอกกล่าวใด ๆ แก่ท่าน บริษัทฯ จะส่งคำบอกกล่าวให้แก่ท่านทางอีเมลที่ท่านได้ให้ไว้แก่บริษัทฯ

20. ความสัมพันธ์ระหว่างผู้ใช้งาน และบริษัทฯ
ไม่มีข้อความใดในข้อตกลงนี้ที่จะก่อให้เกิดความสัมพันธ์ในรูปแบบตัวแทน หุ้นส่วน นายจ้างและลูกจ้าง หรือผู้ว่าจ้างและผู้รับจ้างระหว่างผู้ใช้งาน และบริษัทฯ

21. การโฆษณา
บริษัทฯ สงวนสิทธิในการโพสต์โฆษณาบน Uselessland ทั้งนี้ ไม่ว่าจะเป็นโฆษณาเกี่ยวกับผลิตภัณฑ์ และบริการของบริษัทฯ หรือของบุคคลภายนอกใด ๆ ก็ตาม อย่างไรก็ตาม โปรดแน่ใจได้ว่าการโฆษณานั้นจะเป็นไปอย่างมีจริยธรรม และเนื้อหาในโฆษณาเหล่านั้นจะมีความเหมาะสมต่อผู้เยาว์

22. การใช้งานคุกกี้ (Cookie)
บริษัทฯ ใช้คุกกี้ และเทคโนโลยีติดตามอื่น ๆ ที่มีลักษณะคล้ายคลึงกันบนเว็บไซต์นี้ ทั้งนี้ โปรดอ่านนโยบายการใช้งานคุกกี้ของบริษัทฯ ที่ https://www.uselessland.com/privacy เพื่อทำความเข้าใจถึงรายละเอียดที่เกี่ยวข้องกับการใช้งานคุกกี้

23. เว็บไซต์ของบุคคลภายนอก
Uselessland อาจมีการระบุถึง หรือเชื่อมโยงไปยังเว็บไซต์ของบุคคลภายนอก (“เว็บไซต์ของบุคคลภายนอก”) ทั้งนี้ บริษัทฯ มิได้เป็นผู้ดูแล ดำเนินการ หรือควบคุมเว็บไซต์ของบุคคลภายนอกดังกล่าว จึงมิสามารถให้คำรับรอง หรือรับประกันถึงความปลอดภัย ความถูกต้องสมบูรณ์ หรือความน่าเชื่อถือของเว็บไซต์ของบุคคลภายนอกใด ๆ ได้ และบริษัทฯ จะไม่รับผิดชอบ หรือรับผิดใด ๆ ต่อท่าน หรือบุคคลอื่นใดอันเกิดจากการเข้าถึง และ/หรือใช้งานเว็บไซต์ของบุคคลภายนอกดังกล่าว เพื่อความปลอดภัย และประโยชน์ของตัวท่านเอง บริษัทฯ ขอแนะนำให้ท่านอ่าน และทำความเข้าใจข้อตกลงและเงื่อนไขการใช้งาน นโยบายคุ้มครองข้อมูลส่วนบุคคล และนโยบายอื่น ๆ ที่เกี่ยวข้องของเว็บไซต์ของบุคคลภายนอกโดยละเอียดก่อนใช้งาน

24. ความสมบูรณ์ของข้อกำหนดนี้
หากข้อกำหนดข้อใดข้อหนึ่งในข้อตกลงนี้ถือเป็นโมฆะ ไม่มีผลบังคับใช้ตามกฎหมาย หรือไม่ชอบด้วยกฎหมาย ข้อกำหนดดังกล่าวจะไม่กระทบต่อความสมบูรณ์ การมีผลบังคับใช้ และความชอบด้วยกฎหมายของข้ออื่นใดในข้อตกลงนี้

25. การโอนสิทธิ
ห้ามมิให้ผู้ใช้งานโอนสิทธิให้แก่บุคคลใด ๆ โดยมิได้รับความยินยอมล่วงหน้าโดยชัดแจ้งจากบริษัทฯ อย่างไรก็ตามบริษัทฯ อาจโอนสิทธิให้แก่บุคคลอื่นใด ซึ่งรวมถึงแต่ไม่จำกัดเพียงบริษัทในเครือ หรือบริษัทในกลุ่มได้โดยไม่ต้องได้รับความยินยอมใด ๆ จากท่าน

26. กฎหมายที่ใช้บังคับ และการระงับข้อพิพาท
26.1 ข้อตกลงนี้อยู่ภายใต้การบังคับ และการตีความตามกฎหมายแห่งประเทศไทย

27. ข้อตกลงและเงื่อนไขการเข้าร่วมกิจกรรมและการประกวด
27.1 หากท่านเข้าร่วมกิจกรรม และ/หรือ การประกวดที่จัดโดยเรา ถือว่า ท่านตกลงยอมรับเงื่อนไขการประกวด คำตัดสินของคณะกรรมการ และเงื่อนไขอื่น ๆ ที่เรามี ไม่ว่าจะมีการแจ้งให้ท่านทราบหรือไม่

27.2 เราสงวนสิทธิ์ในการระงับหรือยกเลิกการเข้าร่วมประกวดของท่าน โดยมิต้องบอกกล่าวล่วงหน้า และเราไม่ต้องรับผิดใด ๆ ในการดำเนินการดังกล่าว

27.3 เราสงวนสิทธิ์ในการระงับหรือยกเลิกกิจกรรม และ/หรือ การประกวด โดยมิต้องบอกกล่าวล่วงหน้า และเราไม่ต้องรับผิดใด ๆ ในการดำเนินการดังกล่าว

27.4 หากท่านชนะการประกวด และ/หรือ ได้รับรางวัล ท่านต้องรับผิดชอบค่าใช้จ่ายที่เกี่ยวข้องกับการรับรางวัล เดินทางเพื่อรับรางวัล หรือค่าใช้จ่ายอื่นที่เกี่ยวข้องด้วยตัวท่านเอง เว้นแต่กิจกรรมหรือการประกวดนั้นระบุไว้เป็นอย่างอื่น

27.5 หากท่านชนะการประกวด และ/หรือ ได้รับรางวัล เราสงวนสิทธิ์ในการเผยแพร่รูปภาพและรายละเอียดผลงานที่ท่านส่งเข้าประกวด เป็นระยะเวลา 1 ปี นับจากวันที่ประกาศผลการประกวด ทั้งนี้ ท่านยังคงเป็นเจ้าของไอเดีย

Terms and Conditions

Please read these Terms and Conditions (‘agreement’) carefully before accessing and/or using this website. By accessing and/or using Uselessland (‘this website’ or ‘the website’), by any means, you agree that you have read, understand, and agree to comply and enter into this agreement. If you do not agree with these terms and conditions, please do not access or use this website.

This agreement is between you as a Uselessland user (‘you’, ‘your’, or ‘user’) and 8-Folk Co., Ltd. (‘the company’, ‘we’, or ‘our’). Our company registration number is 0125564024884, and we operate under the laws of Thailand.

1. Definitions and Interpretation
1.1 For the purposes of this agreement, the following words have the following meanings unless their context specifies otherwise.

User account	User account on Uselessland
User	Member, and non-member user
Non-member user	Visitor and/or user of Uselessland who has not signed up for a member account, or had a member account but has closed the member account, or had a member account which was closed by the company
Creator	Member who create an invention and/or upload the invention content on the website
Co-creator	Person who creates an invention with the creator, regardless of whether the person is a member user or not
Website or Uselessland	www.uselessland.com owned and operated by 8-Folk Co., Ltd.
Invention	Any creation that a creator has researched, designed, invented, and created
Member	Users who has registered and has a member account on Uselessland
Parent / Guardian	Parent, authority or legal representative of a minor or those with vulnerabilities
Minor	Person who has not reached the age of legal majority - under the age of 20 (twenty) years old
Vulnerable person	a person who is incompetent or quasi-incompetent as required by applicable laws

1.2 This agreement is written in Thai and English. In case of conflict, the Thai version will be adhered to.

2. Amendments to Terms and Conditions
We reserve the right to make changes, amendments, or modifications to this agreement at any time. Whether or not there is a notice, it is your responsibility to review this agreement on a regular basis to ensure that you are aware of any changes, amendments, or modifications. We may notify you of changes that will have a material effect on you for a reasonable period of time before such changes become effective.

You agree to be bound by this agreement when you continue to access or use Uselessland after the changes, amendments, or modifications. If you do not agree or refuse to be bound by the agreement, please do not continue to access or use this website.

3. Our Services
Uselessland is an online community where members can record, store, and display their inventions. Members can also receive advice or suggestions about their inventions from other members or us. We also provide you with creative games, articles, competitions, creative kits, and creative workshops.

4. Use of Uselessland by Minors
4.1 Access to and use of Uselessland by minors is subject to these terms and conditions:

16 years old and over	You can sign up for a member account using your own email address. You do not need parental consent to sign up.
13 - 15 years old	You can sign up for a member account using your email address. You need to have parental consent to sign up.
Under 13 years old	You cannot have a member account.

4.2 We reserve the right to suspend or cancel your member account immediately without prior notice if you are a minor under the age of 13 (thirteen), and we will not be liable for such action.

5. Signup
5.1 You do not need to sign up for a member account to access Uselessland. However, users without a member account will not be able to post any content on the website and your access to content may be restricted.

5.2 By signing up for a member account, you confirm that you are at least 16 (sixteen) years of age, or if you are between 13 (thirteen) and 15 (fifteen) years of age, you have obtained your parent's valid consent to apply.

Signing up made by vulnerable people requires a guardian consent and must be under the supervision of the guardian. We reserve the right to request evidence of such consent at any time we deem appropriate. We reserve the right to suspend or cancel your member account immediately without prior notice if we find that you had not obtained guardian consent before signing up and we will not be liable for such action.

5.3 By signing up for a member account, you confirm that you have provided accurate, complete, and current information about yourself. You can edit and update your information at www.uselessland.com/account or request us to make the changes for you. We reserve the right to request for evidence to verify the correctness of such changes as we deem appropriate.

5.4 You must not use information of another person without their consent to sign up for a member account. You must not impersonate anyone in any way that infringes on personal rights. To impersonate is considered an offence and you will be punished by laws.

5.5 When you sign up for a member account, you will receive an email from Uselessland to verify your identity. If you do not verify your identity within a specific period, your membership application will be automatically cancelled. Please note that we reserve the sole right to consider, approve, or reject your membership application request.

5.6 You acknowledge and understand that the information about your member account and your password are confidential information. You must not disclose this information to anyone, and must not allow anyone to access your member account.

All actions taken under your member account are deemed to be performed by you. If you find or suspect any misuse of your member account, you must notify us immediately.

5.7 Uselessland is a creative community for people of all ages including minors. For safety and privacy reasons, we do not allow members to upload any images to use as profile pictures. However, you can select a colour that represents yourself. If you do not select your profile colour, the system will automatically assign a colour to you. You can change your profile colour at www.uselessland.com/account.

5.8 Uselessland does not charge any service fees for applying for a member account and for using the website. However, use of the website may incur costs from telecommunication and/or internet networks. You will be responsible for such expenses solely. For information about these expenses, please contact your telecommunication and/or internet network providers.

6. User’s Posting of Invention
6.1 Only members can post pictures and details of their inventions on Uselessland. By uploading the invention to the website, you certify and confirm that the invention is your own work, or the work of your minor or a person under your guardianship.

6.2 You can post pictures of your invention. For your safety and privacy, we ask you to refrain from posting portrait pictures of any person including yourself.

6.3 You can set the visibility of your inventions according to your preferences, and can adjust the settings at any time. The settings are as follows:

On U Things	If you publish your invention as On U Things, both member and non-member users will be able to see your invention. However, only member users will be able to see and make comments on Chitchat, and interact with your invention on ‘Clap', and ‘Clip’. We may use images of your invention for marketing and advertising purposes through various media. We will request permission from you before doing so.
Need Help	If you would like to consult other member users about your invention, save your invention as ‘Need help’. Your ‘Need help’ inventions will appear on the Help Board where other members are able to post suggestions on your inventions.
Private	If you do not want other users to see your inventions, save them as ‘Private’
Workbench	Any invention that has been saved as a draft will appear on Workbench. Other users are not able to see your workbench inventions.

6.4 You can set the visibility of your inventions. The various settings are detailed as follows:

*Note: Users without a member account are not able to see Chitchat, are not able to make comments, are not able to give Clap and Clip, and are not able to upload any user contents to inventions.

6.5 You can mention co-creators of your inventions. For safety and privacy reasons, please use their display names or nicknames instead of names.

6.6 When you change your invention status from ‘Need help’ to ‘On U Things’, ‘Private’, or ‘Workbench’, your invention will be removed from the ‘Help Board’. Other members will not be able to give suggestions to the invention. Suggestions that other members have provided to you will not continue to be visible to you and other users.

7. User-Generated Content
7.1 Any content that you submit, transmit, post or upload on Uselessland is user-generated content.

7.2 Subject to visibility settings by the creator, other members can make comments on inventions via the “Chitchat” and “Need Help” features.

7.3 Any comments posted on “Chitchat” and “Need Help” will be visible to other members. We recommend that you use caution and avoid posting any personal, confidential, or sensitive information.

7.4 You can delete your comments at any time. The creator of the invention you are posting on can also delete your comments. (This feature is currently not available. Please contact us at hi@uselessland.com if you want to delete any of your comments before the feature is available.)

7.5 Using the Clip button, you can save the invention you are interested in on your Keep board. (This feature is currently not available.)

8. Material & Tool Suggestions (currently not available)
The website system may automatically offer materials or tools that are suitable for your future inventions. Suggestions are based on details of prior inventions that you have uploaded to the website.

9. Creativity Scores (currently not available)
If you want Uselessland to perform data processing of your inventions to give a creative score, select “Give me score!” or you may assign a creative score to the invention yourself. Other users will not see your creative scores.

10. Restrictions on Use
10.1 You can not use Uselessland for any commercial purpose.

10.2 You are prohibited from posting or upload any of these user contents on the website:

10.2.1 User contents that may damage the company, other users, or third parties

10.2.2 User contents that cause conflicts, create divisions, or cause a nuisance or hates

10.2.3 User contents that infringe any rights of the company, other users, or third parties, including but are not limited to intellectual property rights

10.2.4 User contents which are false, misrepresented, or may cause misunderstandings

10.2.5 Defamatory user contents or contents that can damage the reputation of other people

10.2.6 User contents related to weapons, explosives, violence, pornography or any kind of pornographic media

10.2.7 Unlawful user contents or contents that violate any applicable laws, regulations, or rules.

10.2.8 User contents that are contrary to peace, orders, and good morals.

10.2.9 User contents that can be used to identify any person including yourself such as a picture of your face, house number, and vehicle registration plate.

11. Suspending or Closing User Accounts
11.1 We reserve the sole right to consider suspending or closing your member account without prior notice if you violate or fail to comply with this agreement, any applicable laws, statutes, regulations, or if we believe that such action will be taken. To the maximum extent permitted by law, we will not be liable or responsible for suspending or closing such member accounts.

11.2 In the event that we will cease all or part of Uselessland services, we will notify you at least 30 (thirty) days in advance to give you reasonable time to save your user contents.

11.3 If you no longer wish to use Uselessland, you may delete your member account at any time at https://www.uselessland.com/account

12. Confidentiality
We will keep any personal information that users provide to the company a secret and will not disclose any such information to third parties without your consent, except in the cases provided in this agreement, and/or disclose to our service providers for the purposes provided in this agreement. Confidential information does not include information that you have made public by yourself.

You acknowledge that we may be required to disclose your information in order to comply with applicable laws, court orders, or authority orders. For the list of third parties who may be exposed to your personal information, please see our privacy policy (https://www.uselessland.com/privacy)

13. Intellectual Property Rights
13.1 Except as provided in clause 12.2, the company is the owner of the rights, and all interests in connection with this website solely. This includes but is not limited to contents, designs, texts, drawings, photographs, trademarks, logos, and other intellectual properties, unless explicitly stated otherwise. No one is allowed to copy, reproduce, have a backup copy, make a copy, duplicate, modify, add, or distribute anything from the website for any purposes without written consents from us.

13.2 The user warrants that your user contents posted on the website does not infringe the intellectual property rights of others in any way. By posting your contents on the website, you allow the company to exercise the right to amend, change, and publish your contents in various channels as we deem appropriate. These rights are indefinite, irrevocable, no compensation, can be used worldwide, and can be exercised indefinitely even if the user has removed the contents from the website.

14. Personal Data
Your personal data that you have provided to the company or which the company has collected from your access and/or use of Uselessland will be as set out in our privacy policy (https://www.uselessland.com/privacy) The privacy policy is part of this agreement. Please read our privacy policy carefully and with caution.

15. Disclaimers
15.1 We make no guarantees that Uselessland will always be available, provided that our services are provided on an “as is” and “as available” basis only. The user determines whether the website can be used as and/or appropriate for your specific purposes.

15.2 The purpose of Uselessland is to provide a creative learning environment which means the website may be changed, modified, or updated at any time to improve website performance. We do not endorse and do not warrant that Uselessland will always remain the same.

15.3 Although we backup the website from time to time, we do not guarantee that any data, including user contents, will not be damaged or lost.

15.4 We do not certify the correctness or the integrity of any contents which appear on Uselessland, and do not warrant that such contents will be free from infringement of the rights of users. However, if we find or are notified of any inaccuracies, incompleteness. or infringement of rights, we will investigate and take any necessary actions to remove those contents from the website.

15.5 We do not warrant that Uselessland will be free from malware, virus, worm, or anything of a similar nature.

15.6 We make no guarantees that Uselessland will work with your device and/or any of your softwares.

15.7 We reserve the right to not allow users to use the website, including the right to change or suspend the service of the website whether in part or in whole and at any time.

16. Limitation of Liability
16.1 In connection with your use of Uselessland or resulting from any error, absence, interference, or delay in the performance of the website; to the maximum extent permitted by laws, we will not be liable, or be held liable for any damage, loss, and liability.

16.2 Nothing in this agreement will be construed as a limitation of liability; a) gross negligence caused by will, b) in relation to death or injury, c) which is prohibited by laws, d) which is against order or good morals.

17. Indemnification
In connection with your access and/or use of Uselessland in a manner that violates or fail to comply with this agreement or applicable laws, you agree to be responsible for any indemnification, and protect the company including, but not limited to, directors, officers, employees, agents and our representatives from any damages, losses, and liabilities including reasonable attorney's fees.

18. Waivers
Our delay in exercising the right, or non-exercising any rights under these terms and conditions or applicable laws, whether it is all or in part, will not be deemed a waiver of such right by the company.

19. Notices
If you wish to give any notice to us, please send such notice to hi@uselessland.com. When we need to send you notice, we will contact you using the email address that you use to register for your member account.

20. Relationship Between User and Uselessland
Nothing in this agreement will create an agency, partnership, employer and employee, or employer and contractor relationships between the user and the company.

21. Advertising
We reserve the right to advertisements including product-related advertisements and our services on Uselessland. Please ensure that our advertising is ethical and the advertisement contents will be appropriate for minors.

22. Cookies

23. Third Party Websites
Uselessland may have links to third party websites. We do not maintain, operate, or control such third party websites. We therefore are unable to certify or guarantee the safety, completeness, or reliability of any third party websites. We will not be responsible or liable to your or any person’s access and/or use of such websites. For your safety and benefit, we recommend that you read and understand the terms and conditions, privacy policy, and other relevant policies of the third party websites in detail before accessing and/or using them.

24. Completeness of Agreement
If any provision of this agreement is void, not legally enforceable, or unlawful, the provision will not affect the completeness, entry into force, and legality of any other clauses in this agreement.

25. Transfer of Rights
Users are prohibited from transferring their rights to any person or entity without our consent. However, the company may transfer rights to any other person or entity including, but is not limited to, affiliated companies without obtaining any consent from you.

26. Governing Law and Dispute Resolution
26.1 This Agreement will be governed by, and construed in accordance with, the laws of Thailand.

26.2 In the event of any dispute regarding the use of Uselessland or this Agreement, you agree that the court of Thailand has the authority to decide and settle all such disputes.

27. Competitions and Challenges
27.1 By participating in competitions or challenges organised by us, you agree to terms and conditions of the competition, jury decisions, and other terms and conditions that we have whether or not you have been informed about them.

27.2 We reserve the right to suspend or cancel your participation in our competitions or challenges without prior notice, and we will bear no liability for doing so.

27.4 If you win a competition or challenge and/or receive a prize, you are responsible for the costs associated with receiving the prize and other related expenses, unless the competition or challenge states otherwise.

27.5 If you win a competition or challenge, we reserve the right to publish photos and details of your submitted entries for one year from the date of announcement of the contest results. You continue to be the owner of your entry idea.
